The photos and website content you see on HamiltonPix.com are intellectual property belonging to HamiltonPix.com as the legal and rightful owner. If copyright protected property is used in any way without the consent of its owner, that usage would constitute a violation of the legal rights of the owner and would put the user in a position vulnerable to whatever claims the property owner might make against them. Copyright infringement is prevalent and it is serious enough that photo retailers and copy shops such as Costco and FedEx Kinko's have implemented strict policies to protect them from the liability of being used in the process of copyright infringement. Here is an excerpt from such a policy from one major retailer...
"...understand that Costco Photo is unable to provide you with permission to copy, display, or distribute material for which you do not own the copyright. You may not copy or distribute such material without the written consent of the copyright owner, and you are solely responsible for any copyright violations that you may incur as a result of your activities on the [Costco] Service. Costco Photo has the absolute right to terminate your Costco membership or exclude you from the Site if you use our Service to violate the intellectual property rights of third parties..."
License to Use a Digital Photo: Personal Use License: 1) This license is for personal use only. Personal use means non-commercial use of the image(s)for display on personal websites and computers, or making prints for personal use. The image(s) may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The image(s) may not be used in advertising. The image(s) may not be resold, re-licensed, or sub-licensed. The image(s) may not be provided to other parties outside of family use in their digital format.
Most orders from HamiltonPix.com are for a picture or hardcopy of an image and have a single use—to view, scrapbook, etc… Now you may purchase a license to freely use the digital image in accordance with our Personal Use License. This is done as a Digital Image Download or Image Transfer.
Prices for most Digital Downloads or Image Transfers range from $19.95 to $39.99 per image. Our price is just $15 per image.
How to order a Digital Image Transfer:
View and order your pictures just like normal. If you select "Image Transfer" in place of a "print", follow the instructions provided by Shutterfly.com to set up a free Shutterfly account and the image will be transfered to your new accout for your personal use.
Return Policy on Digital Image Transfers:
HamiltonPix.com is unable to offer refunds on digital product purchases once the photos have been digitally transmitted. Your payment signifies your understanding and acceptance of this policy. We are available and eager to assist you with any questions about the photos you plan to order. Contact us PRIOR to placing your download order if you feel you need assistance.
HamiltonPix.com grants buyer a non-exclusive perpetual personal-use license subject to the following restrictions:
